This State Instruction provides clarification on the use of self-attestation as a documentation source for establishing Workforce Investment Act (WIA) program eligibility for adults, dislocated workers, and youth.

TEGL 28-11 describes the data element validation process and documentation requirements for WIA (PY 2011). The data element validation process for WIA must be completed and the results submitted to US DOL by February 1, 2013. This requires the review of case files for a sample of exiters from the WIA PY 2011 Annual Report. The reviews will be conducted by SC Department of Employment and Workforce staff.

To provide Local Workforce Investment Areas (LWIAs) instruction for compliance related to obligation and expenditure of WIA funds; and to transmit the Voluntary Rea/location Request Form.

To establish the rules and procedures for providing language access services to Employment Services (ES) customers with limited English proficiency (LEP) in SC Works centers.

To inform grant recipients of the (1) sanctions that may be imposed for violation of the nondiscrimination and equal opportunity provisions of the Workforce Innovation and Opportunity Act (WIOA), and (2) to outline the procedures to achieve voluntary compliance, i.e. corrective action/remedy.

The purpose of this instruction is to transmit the attached handout and establish procedures for handling noncriminal complaints under the Workforce Innovation and Opportunity Act (WIOA). Nothing contained in the attached handout shall be deemed to prejudice the separate exercise of other legal rights in pursuit of remedies and sanctions available outside of WIOA.

To issue State policy concerning the management of source documents for Trade Adjustment Assistance (T AA) Program participants. This policy rescinds the State Employment Services Instruction Number 12-13 (TAA Participant Source Document Management) issued on March 8, 2013.
