To establish the rules and procedures for providing language access services to Employment Services (ES) customers with limited English proficiency (LEP) in SC Works centers.

To outline additional possible sanctions that may be imposed for violation of the nondiscrimination and equal opportunity provisions of the Workforce Innovation and Opportunity Act (WIOA). No other changes have been made to the policy and procedures issued in State Instruction 16- 17.

To inform grant recipients of the (1) sanctions that may be imposed for violation of the nondiscrimination and equal opportunity provisions of the Workforce Innovation and Opportunity Act (WIOA), and (2) to outline the procedures to achieve voluntary compliance, i.e. corrective action/remedy.

To establish the procedures for the timely investigation and resolution of grievances and complaints alleging violations of the Workforce Innovation and Opportunity Act (WIOA) under Section 181 of WIOA. These procedures do not apply to discrimination complaints brought under Section 188 of WIOA and/or 29 CFR part 38. Such complaints must be handled in accordance with the procedures set forth in State Instruction Number 16-15. Nothing in these procedures precludes a grievant or complainant from pursuing a remedy authorized under another Federal, State, or local law.

To establish procedures for handling complaints of discrimination on a prohibited basis or bases under Section 188 of the Workforce Innovation and Opportunity Act (WIOA). Nothing contained in the procedures shall be deemed to prejudice the separate exercise of other legal rights in pursuit of remedies and sanctions available outside of WIOA.

This guidance transmits electronic, word-fillable versions of the Workforce Innovation and Opportunity Act Rights Handout for Registrants, Applicants, and Participants in both English and Spanish.

Nothing contained in the handout shall be deemed to prejudice the separate exercise of other legal rights in pursuit of remedies and sanctions available outside of WIOA.
