The purpose of this State Instruction is to make available the 'Equal Opportunity Is The Law' notice in English, Spanish, Arabic, Chinese Traditional, French, French Creole, Korean, Portuguese, Russian, Tagalog, and Vietnamese. 29 CFR Part 38 implements the nondiscrimination and equal opportunity requirements under WIOA and prescribes key responsibilities of WIOA-funded staff and the Local Workforce Development Areas (LWDAs).

The purpose of this instruction is to transmit the attached handout and establish procedures for handling noncriminal complaints under the Workforce Innovation and Opportunity Act (WIOA). Nothing contained in the attached handout shall be deemed to prejudice the separate exercise of other legal rights in pursuit of remedies and sanctions available outside of WIOA.

To provide guidance relative to the information included in Training and Employment Guidance Letter (TEGL) 31-11 about exclusions based on criminal records, and how they are relevant to the existing nondiscrimination obligations for the public workforce system.

To issue State policy concerning the management of source documents for Trade Adjustment Assistance (T AA) Program participants. This policy rescinds the State Employment Services Instruction Number 12-13 (TAA Participant Source Document Management) issued on March 8, 2013.
